This Legal Notice regulates the conditions of access and use to the website www.dalrit.com and/or its subdomains and digital applications (hereinafter the “Website”) that DALRIT, S.L. makes available to internet users.

A user is understood as a person that accesses, browses and uses or participates in the services and activities of the website.

The access and browsing of a user on a website imply the full acceptance of the Legal Notice, so please read it carefully.

DALRIT, S.L. can offer services through the website that may be subject to their own particular conditions which the user will be notified of in each specific case.

The content of www.dalrit.com and/or subdomains of the digital applications are produced by DALRIT, S.L.

Any information related to DALRIT, S.L. (composition and product prices, services, offers, promotions, raffles, campaigns, corporate information, etc.) that can be found on or included in other websites, emails, forums, etc., will only be considered truthful and legally binding if DALRIT, S.L. has expressly confirmed said information.

4.1. Use the Website, its content and services in accordance with the law, this current Legal Notice, good customs and public order.

4.5. Make appropriate use of the content and services that DALRIT, S.L. offer on its Website and to not use them to engage in illicit activities or contrary to good faith and the legal code, to spread content or propaganda of racist, xenophobic, pornographic nature, advocating terrorism or infringing human rights.

5.- Access to the Website.

5.1. Access and use of the Website is open and free.

5.2. Some of the services and content offered by DALRIT, S.L. may be subject to registration and/or prior contracting and payment determined by the General Conditions of Registration and Contracting, which will be made clear and available to the user.

5.3. The registration and contracting of products and services of the Website is prohibited to minors. Prior to registration, minors must obtain consent (and be able to prove it if required) of their parents, guardians or legal representatives, who will be considered responsible for the acts carried out by the minors.

5.4. DALRIT, S.L. may also establish mandatory Particular Conditions that regulate the use and/or contracting of specific products or services offered to the user on the Website. Therefore, before using and/or contracting said products or services, the user must carefully read the corresponding particular conditions created by DALRIT, S.L.

The registration and/or use of the products and services offered on the Website imply the acceptance of the general and/or particular conditions currently published by DALRIT, S.L. at the time of use and/or contracting.

5.5. The user will be held responsible for inputting truthful and lawful information if they are required to register in order to use a service offered on the Website. If as a result of registration the user is provided with a password, they commit to using it conscientiously and to keeping it secret. Users are responsible for the proper custody and confidentiality of any usernames or passwords provided by DALRIT, S.L. and are forbidden to assign them to third parties either temporarily or permanently. The use of the services by an illegitimate third party due to a user’s non-diligent use or loss of a password will be the user’s responsibility.

The user is obliged to notify DALRIT, S.L. of any reason that allows the improper use of a username and/or password, such as theft, loss or unauthorised attainment in order to proceed with an immediate account cancellation. Unless the user has notified of such events, DALRIT, S.L. remains exempt from any liability that may arise from the improper use of a username and/or password by unauthorised third parties.

5.7. All personal data will be collected and processed in accordance with the information stipulated in section 6 of this Legal Notice and in the General Conditions of Registration and Contracting.

6.- Protection of personal data.

6.1. DALRIT, S.L. adopts the necessary technical and organisational measures to guarantee the protection of personal data and prevent their modification, loss, processing and/or unauthorised access, taking into account the technical state, the nature of the stored data and the risks they are exposed to. All of this in accordance with the Spanish legislation on the Protection of Personal Data (Law 15/1999 on the Protection of Personal Data and Royal Decree 1720/2007, for which said law is approved).

As of 24/05/2018, the application of the REGULATION (EU) 2016/679 of the EUROPEAN PARLIAMENT AND COUNCIL of 27/04/2016 protects individuals with regard to the processing of personal data and the free movement of such matter, Directive 95/46/CE (General Regulation of Data Protection).

6.2. The user may submit their personal data to DALRIT, S.L. using the different forms that appear on this Web, which are designed for this purpose. User data, if submitted, will be incorporated into a file owned by DALRIT, S.L. and are necessary in order to proceed with registration, maintain a relationship with the user, manage the requested services and carry out the management, administration, provision, expansion and improvement of activities for a more personalised and efficient service.

A user may exercise their rights to access, rectification, cancellation and opposition by directly contacting DALRIT, S.L. at their physical address or by sending an email to dalrit@dalrit.com.

7.- Limitation of guarantees and responsibilities.

7.1. DALRIT, S.L. commits to making its best efforts to avoid any error in the content that could appear on the website.

In any case, DALRIT, S.L. will be exempt from any responsibility derived from eventual error in content that could appear on the Website, provided they are not attributable to it.

7.2. DALRIT, S.L. does not guarantee that the Website or server are free of virus and will not be held responsible for any possible damage or loss derived from interference, omissions, interruptions, IT viruses, telephone failures or disconnections in the operational function of this electronic system, caused by reasons beyond the control of DALRIT, S.L. DALRIT, S.L. will also not be held responsible for delays or blockages in the use of this electronic system caused by deficiencies in telephone lines or overloading of the internet system, as well as any damages that may be caused by third parties through the illegitimate interference beyond the control of DALRIT, S.L..

8.- Intellectual and industrial property. All rights reserved.

8.1. The source codes, computer programs, texts, designs, images, databases, logos, structure, trademarks and all other elements of the Website are protected by laws and international treaties regarding intellectual and industrial property.

8.2. All Intellectual and Industrial Property rights of this Website and its contents belong to DALRIT, S.L., the author of the collective work, or where appropriate, to third parties.

8.3. The user commits to respect the Intellectual and Industrial Property rights owned by DALRIT, S.L. and third parties.

8.4. The user can view all elements of the Website, they can print them, copy them and save them to their device or any other physical medium as long as it is exclusively for personal and private use, and therefore it remains forbidden the reproduction, distribution and public communication, including the method of making available of all, or part of the Website content for commercial purpose, in any medium and by any technical means. Modification, alteration or decompilation is also strictly forbidden without the authorisation of DALRIT, S.L.

The sharing of this Website on social networks is authorised provided that it is not for commercial purposes.

11.- Limitation of liability of DALRIT, S.L.

11.1. DALRIT, S.L. commits to making its best efforts to avoid any error in the content that could appear on the Website If at any time an error occurs beyond the control of DALRIT, S.L., it will be corrected as soon as we are made aware.

11.2. In no case is DALRIT, S.L. responsible for damages of any nature that may arise from possible errors in the content, provided that they are not attributable to it. Nor will they be held responsible for damages that may be caused by third parties through illegitimate interference beyond the control of DALRIT, S.L.

11.3 DALRIT, S.L. is exempt from liability for service deficiencies attributable to the server centre or connection networks, and from the damage that any virus or malicious program could cause.

12.2 Communications from DALRIT, S.L to the user will be made in accordance with the data provided by the user in the electronic registration form.

12.3 The user cannot use the Website or communication tools to collect addresses, send spam or breach this Legal Notice or the privacy policy. DALRIT, S.L. may review or filter user messages to control malicious activity or prohibited content, but does not store messages permanently. Please contact DALRIT, S.L. to report any spam received from other users.

13.- Applicable law and jurisdiction.

All issues that arise between DALRIT, S.L. and the user regarding the interpretation, compliance and validity of this Legal Notice will be governed by its own clauses and in accordance with Spanish legislation, expressly submitting the parties to the jurisdiction of the Courts of the domicile of DALRIT, S.L.
